We may modify or update these Terms of Service and our Privacy Policy at any time.
We may use artificial intelligence and machine learning to operate or improve our Services. Personal data processed by these technologies is subject to the same terms as other data.
DEFINITIONS.
“Agreement” means this Privacy Policy, our Terms of Service, and any other agreement you may enter into with us for Services.
“User,” “you,” “your,” means any user of any of our Services.

YOU MAY ONLY USE OUR SERVICES FOR LAWFUL PURPOSES, AND YOU MUST BE AT LEAST 18 YEARS OF AGE. WE DO NOT KNOWINGLY COLLECT PERSONALLY IDENTIFIABLE INFORMATION FROM ANYONE UNDER THE AGE OF 18. DO NOT USE OR ACCESS OUR SERVICES OR PROVIDE US WITH ANY INFORMATION ABOUT YOURSELF IF YOU ARE UNDER 18 YEARS OF AGE OR OUTSIDE THE UNITED STATES.
BY ACCESSING OUR SERVICES, YOU REPRESENT AND WARRANT YOU ARE AT LEAST 18 YEARS OF AGE, AND IF PURCHASING AGE-RESTRICTED SERVICES, YOU REPRESENT AND WARRANT YOU ARE OF LEGAL AGE TO PURCHASE SUCH SERVICES. COMPLIANCE WITH LAWS.

In general, Company operates this website, and provides IT support services, and related incidental products and services, all included in the definition of “Services” as first provided above. Company shall have complete discretion to determine the content, products, and services of the Services, which may include from time to time, this website, IT support services, a mobile application, social forums, merchandise sales, activities, events, and/or other services. Company may expand, contract, amend, modify, edit, delete, or eliminate part or all of the Services at any time, for any reason or no reason, in its sole discretion, and does not guarantee the existence or functionality of any particular Service at any given time.

- In our effort to provide you with ongoing Services and service our relationship with you, we may send you emails informing you of specials, events, or new features that may interest you or may be relevant to your continued use of the Services. Upon creating an account with us, you will be given the option to “opt in” to receiving optional emails, i.e. emails of interest but not essential to your account or continued use of the Services. If you do not “opt in,” we will not send you such emails. Regardless of your “opt in” or “opt out” of optional emails, we reserve the right to send you emails regarding your account or matters related to your continued use of the Services.

We collect the following categories of Personal Information, as defined by applicable U.S. state privacy laws. The specific items of data we collect within each category may vary depending on your interactions with the Services. The following are examples, although other types of relevant Personal Information may be collected.

Geolocation Data. Includes general location derived from IP address, device settings, or browser activity. We do not collect precise geolocation unless you expressly enable it in a mobile app.

Inferences Drawn From the Above. Includes internal analytics about your preferences or use of the Services. We do not create profiles that intentionally produce legal or similarly significant effects.
Sensitive Personal Information (where applicable). Includes governmentissued identification numbers used solely for ageverification or legal compliance (driver’s license, passport, etc.), credit/debit card numbers, precise geolocation, racial or ethnic origin, religious beliefs, health related information, social security number. We do not use or disclose Sensitive Personal Information for any purpose except for providing you with Services, and not for any purpose requiring an optout.
Voluntarily Provided Personal Information. We also collect any other Personal Information you choose to provide, including comments in social features, posts or interactions on our social media or communication forums, and information you provide in emails, texts, uploads, forums, or other communications. This may include your comments, posts, reactions, and contact list information if you link or register through a ThirdParty Social Media Service.
PUBLIC PLATFORM.
Some of features of the Services may be public-facing and accessible to multiple users or the general public, with or without an account, for example, and without limitation, community messaging or User reviews of Company’s Services. Company may, in its sole discretion, and with User’s consent, provide User with interaction with public facing elements of the Services. By providing any information into public facing components of the Services, you are consenting and directing us to share this information publicly and freely.
If or when you submit Content (e.g., a post, comment, message, upload, or any other data or information, including Personal Information, that you deposit into the Services) to a public facing component of the Services, any visitors to and users of our Services may be able to see that Content, any name or username associated with the Content, and the date and time you originally submitted the Content. That Content may also be available in publicly available search results on Internet search engines, such as, without limitation, Google, or in responses provided by an AI chatbot, such as, without limitation, OpenAI’s ChatGPT. You should take the public nature of any public facing Services into consideration before posting or uploading Content.
LINKS AND THIRD PARTY SERVICES.
Our Services may contain links to other websites that are not operated by Us. If You click on a third party link, You will be directed to that third party’s site. We strongly advise You to review the Terms of Service and Privacy Policy of every site You visit. You acknowledge and agree we have no control over and no liability for the content, Terms of Service, Privacy Policies, policies, practices, or operations of any third party sites or services.
Providing You with Services may involve third party servicers (“Third Party Servicers”) who carry out work for us, in our sole discretion. For example, without limitation:
- Our advisors (e.g. accountant, lawyer), providers of our data management programs, such as, without limitation, email and internet service providers, cloud providers who host data, data backup services, web manager, web designer, IT service providers, payment processors, couriers, freight forwarders, third-party ads measurement providers who may help us and advertisers measure the performance of ads shown on our Services, compliance providers who may help us determine your eligibility to participate in programs or events, event planners, event hosts and venues, and other business servicers. Third Party Servicers may have access to your Personal Information on or within our Services, and their use of your Personal Information will be governed by their Terms of Service and Privacy Policies, which you agree to by using our Services.

TRANSFER, PROCESSING, AND SHARING OF YOUR INFORMATION.
Our office and business operations are located in the United States. All Personal Information is transferred to and processed in the United States. your data, including Personal Information, is processed at our operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

To enforce our rights and promote safety and security. We may share Personal Information if we believe your actions are inconsistent with our Terms of Service, rules, or other policies, or to protect the rights, property, and safety of the Services, ourselves, our Company, or others.
With our affiliates. We may share Personal Information between and among our parent, affiliate, subsidiary, and other companies under common control or ownership.

We track search terms entered in Search function as one of many measures of what interests our users. But we don’t track which terms a particular user enters.
Provision of Services and Business Purposes. We may share Personal Information to the extent necessary for us to provide the Services, for the Business Purposes identified in this Privacy Policy, to operate our website and other business operations, and maintain record keeping.
DATA INTEGRITY AND SECURITY.
You acknowledge and agree that no data transmission or storage system can be guaranteed to be 100% secure. We will take reasonable steps to stop and remediate any unauthorized access, disclosure, alteration, or processing that we become aware of. The initial storage provider is Microsoft Azure and at least initially, non-email data is backed up for thirty (30) days or according to Microsoft Azure’s policies, and may change without notice if Microsoft Azure’s policies change, or if we change packages or providers. Email data is not backed up. Non-email data is stored in Azure, and two other data centers. We reserve the right to change the storage provider, any backup provider, any other Third Party Servicers, or levels of service with Third Party Servicers, at any time, without notice. The use and storage of your Personal Information is further governed by their terms of service or our contract with them, and you agree to same.
If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us of the problem by emailing our Data Protection Officer at dataprivacy@corp.power1.com.
DURATION OF PERSONAL INFORMATION STORAGE AND PROCESSING; DELETION.
Unless you request otherwise, Personal Information that you provide us will be retained for the shorter of: (a) for as long as consent was originally provided, (b) the duration of any applicable contract to which you are a party, (c) until consent is revoked, (d) as long as we have a legitimate business purpose for it, including, without limitation, security purposes, (e) for as long as our backup storage provider stores it, or (f) as long as we have a legal purpose for it, including, without limitation tax, audit, investigative purposes.
YOU ALWAYS HAVE THE RIGHT TO REQUIRE US TO ACCESS, CORRECT, OR DELETE YOUR PERSONAL INFORMATION FROM OUR DATABASE, EXCEPT TO THE EXTENT WE ARE REQUIRED BY LAW TO RETAIN ANY SUCH INFORMATION (E.G. FOR TAX OR AUDIT PURPOSES). UPON VERIFICATION OF YOUR IDENTITY, WE WILL PROVIDE YOU WITH A COPY OF ALL OF YOUR PERSONAL INFORMATION IN OUR POSSESSION OR CONTROL WITHIN 30 DAYS OF REQUEST. UPON VERIFICATION OF AN INACCURACY IN YOUR PERSONAL INFORMATION, WE WILL CORRECT IT AND FORWARD THE CORRECTION TO OUR CLIENT WHO ORIGINALLY PROVIDED US WITH YOUR PERSONAL INFORMATION, FOR THEIR CORRECTION AS WELL. WE WILL NOT MAKE CHANGES THAT WE BELIEVE WILL VIOLATE ANY LAW (WHICH MAY INCLUDE LAWS APPLICABLE TO US OUTSIDE YOUR COUNTRY) OR WILL BE FRADULENT OR DECEPTIVE. YOU ACKNOWLEDGE THAT IF YOU HAVE US DELETE YOUR PERSONAL INFORMATION IT WILL NECESSARILY DELETE YOUR ACCOUNT AND WE WILL NO LONGER BE ABLE TO PROVIDE YOU WITH USE OF THE SERVICES. IF YOU REQUIRE DELETION OF YOUR PERSONAL INFORMATION WHILE YOU HAVE A PENDING SERVICES CONTRACT, YOU COULD LOSE ALL CONTRACTED SERVICES AND MONIES PAID, BECAUSE WE WILL HAVE NO WAY OF CONTACTING YOU. YOU ARE FULLY RESPONSIBLE FOR ALL LOSSES AND DAMAGES TO YOURSELF, TO COMPANY, AND TO OTHERS FOR ANY REQUEST TO DELETE YOUR OR A TRAVEL GROUP MEMBER’S PERSONAL INFORMATION FROM THE SERVICES. A REQUEST TO DELETE YOUR PERSONAL INFORMATION WILL ALSO MEAN RECOVERY OF YOUR ACCOUNT AT A LATER DATE WILL NOT BE POSSIBLE.
ANY DELETION OF PERSONAL INFORMATION OR WITHDRAWAL OF CONSENT SHALL NOT AFFECT THE LAWFULNESS OF USE, STORAGE, OR PROCESSING BEFORE ITS WITHDRAWAL OR DELETION.
If you request that we delete your Personal Information, we may, in our sole and absolute discretion, retain any non-personal information you have provided to us.
SECURITY.
You acknowledge and agree that no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), or if you desire correction or deletion of your Personal Information, please immediately notify us of the problem by emailing our Data Protection Officer at dataprivacy@corp.power1.com.
TRUTHFULNESS AND INDEMNITY.
You agree not to input into our Services or any other medium owned, managed, or controlled by us or any Affiliate of us, any untrue, inaccurate, misleading, deceptive, bullying, abusive, harassing, illegal, or otherwise harmful, offensive, or irrelevant content (as determined by us), nor shall you input the Personal Information of another person or entity without their express written consent. You will indemnify, defend, and hold harmless us and our Business Relations, along with any third party whose Personal Information you misuse according to our Terms of Service or Privacy Policy, or the terms of service of any of our Third Party Servicers (“Indemnified Parties”) from and against any and all claims, losses, damages, actions, costs, expenses, and liabilities of any kind or nature whatsoever (including without limitation attorney’s fees), incurred by an Indemnified Party, arising from or relating to violation by you or your representative of this Privacy Policy or our Terms of Service, or any act of deceit, dishonesty, fraud, violation of law, or violation of third party right by you or your representative; and Indemnified Parties shall have the right to recover from you any and all losses and damages of any and every kind or nature arising therefrom or relating thereto, including, without limitation, attorney’s fees.
GDPR.
Even though our business is based in the United States and primarily serves U.S. customers, our Privacy Policy is drafted with the protections and standards of the European Union’s (“EU”) General Data Protection Regulation (“GDPR”) in mind, as some of the provisions overlap with various consumer data protection laws in the United States. GDPR Article 27 provides that non-EU businesses are exempt from appointing a GDPR representative if: (a) processing of the Personal Information of individuals located in the European Union or European Economic Area (“EU/EEA”) is occasional and does not include large scale processing of special categories of data, does not include processing of Personal Information relating to criminal convictions and offenses, and is unlikely to result in a risk to the rights and freedoms of natural persons, taking into account the nature, context, scope, and purposes of the processing.

AUTHORIZED AGENT INSTRUCTIONS.
You may designate an authorized agent to submit a privacy request on your behalf. The authorized agent must provide:
(a) written permission signed by you authorizing the agent to act for you; and
(b) proof of their identity; and
(c) proof of your identity sufficient for us to verify the request.
We may reject a request from an agent who does not provide sufficient documentation.
CALIFORNIA SPECIFIC PROVISIONS.
The following statement is provided in response to California’s Online Privacy Protection Act (CalOPPA):
When you visit a website in any browser, your computer typically and automatically shares information with that website, such as cookies, your IP address, and other standard computer information. If the website contains information provided by a third party (for example, a map, advertisement, or web measurement tools such as a web beacon or scripts), some information about you may automatically be sent to the content provider. This may have several benefits, including, for example only (whether or not the same are actual benefits in this case), and without limitation, allowing you to access third party information on the website, or free or reduced cost access in exchange for accepting advertisements. Our app, any websites owned, controlled, or operated by us, and our business model are not set up to respond to Do Not Track requests, and will not respond to such requests. We also have no control over, and are not responsible for, tracking associated with third parties’ interactions with our website or app, for example and without limitation, Google Analytics and AdWords.
California customers may request that we provide the identity of any third parties with whom we have disclosed Personal Information for the third parties’ direct marketing purposes within the previous calendar year, along with the type of personal information disclosed. We do not intentionally disclose Personal Information to third parties for their own direct marketing purposes.
OTHER STATE-SPECIFIC PROVISIONS.
Residents of Colorado, Connecticut, Delaware, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, and Virginia have the right to tell us not to use Personal Information to create profiles about you that we use to inform decisions that have legal or similarly significant effects. We do not use Personal Information to profile you to further decisions that have legal or similarly significant effects, except as required by Law.
You have a right to tell us not to sell Personal Information or process it for certain targeted advertising purposes. The laws vary in the way they define sale and certain targeted advertising, but generally, they require that we provide you with the ability to limit activities that involve disclosing Personal Information for monetary or other valuable consideration and using Personal Information about you from your activity across other websites or apps to target ads to you. The definitions do not cover all disclosure of Personal Information. We do not knowingly collect, use, store, process, market, lease, or sell Personal Information related to persons under 18 years of age, or knowingly use such information for targeted advertising purposes.
Colorado & Illinois Biometric Information Privacy: We do not collect biometric identifiers or biometric data.
COOKIE STATEMENT.
Cookies are small pieces of text sent as files to your computer or mobile device when you visit most websites. Cookies may be delivered by us (first party cookies) or delivered by a third-party partner or supplier (third-party cookies). Cookies are either session cookies or persistent cookies. Session cookies enable sites to recognize and link the actions of a User during a browsing session and expire at the end of each session. - Pixels are small objects embedded into a web page that are not visible to the User. We use pixels to deliver cookies to your computer, facilitate the log-in process, monitor the activity on our sites, and deliver online advertising.
- Tags are small pieces of HTML code that tell your browser to request certain content generated by an ad server. We may from time to time use tags to show you relevant advertising and promotions.
- Scripts are pieces of JavaScript code that launch automatically when certain webpages load, to determine whether Users view associated advertisements.
- Local Storage Objects, such as HTML 5, are used to store content and preferences. Third-parties with whom we partner to provide certain features on our site to display advertising based upon your web browsing activity use Local Storage Objects to collect and store information.
